North-West Youth Entrepreneurship Service Fund Act, Repeal Act, 2025

Act 1 of 2025

ACTTo provide for the repeal of the North West Youth Entrepreneurship Service Fund Act, 2016 (Act No 6 of 2016) and to provide for matters connected therewith.BE IT ENACTED by the Provincial Legislature of the North-West Province, as follows:—

1. Definitions

In this Act, unless the context indicates otherwise—"Fund" means the North West Youth Entrepreneurship Service Fund;"Department" means the Office of the Premier in the North West Province;"Gazette" means the official Provincial Gazette of the North-West Province;"Head of Department" means the most senior officer of the Office of the Premier in the North West Province;"Provincial Treasury" means the Treasury established for North-West under section 17 of the Public Finance Management Act, 1999 (Act No. 1 of 1999);"regulations" means regulations made in terms of section 4;"responsible Member" means the Premier of the North West Province; and"this Act" includes the regulations contemplated in section 4.

2. Repeal of law

The North-West Youth Entrepreneurship Service Fund Act, 2016 (Act No 6 of 2016), is hereby repealed.

3. Disestablishment of Fund and transitional provisions incidental thereto

(1)The Fund, is hereby disestablished.
(2)On the date of the commencement of this Act, all assets, liabilities, rights, duties and obligations, including any unspent portion of any funds accrued or received under the repealed Act, of the disestablished Fund, are transferred to, and vest in, the Department.
(3)The Department is, in respect of the assets, liabilities, rights, duties and obligations and funds referred to in subsection (2), for all purposes the successor-in-law of the disestablished Fund.
(4)The responsible Member must, subject to applicable labour law, address all issues relating to the employees of the disestablished Fund who were appointed in terms of the relevant provisions of the repealed North-West Youth Entrepreneurship Service Fund Act, 2016.

4. Responsible Member may make regulations

The responsible Member may, if in the application of this Act, administrative problems are being experienced, by notice in the Gazette, make regulations to deal such administrative problems.

5. Validation

Any act, determination, designation, decision, matter or any other thing done, made, taken, executed or carried out or purported to have been done, made, taken, executed or carried out by the Board of the disestablished Fund appointed in terms of the repealed North-West Youth Entrepreneurship Service Fund Act, 2016, in terms of or in pursuance of the repealed North-West Youth Entrepreneurship Service Fund Act, 2016, up to the date of commencement of this Act, is not invalid by reason of the repeal of the North-West Youth Entrepreneurship Service Fund Act, 2016.

6. Short title

This Act is called the North-West Youth Entrepreneurship Service Fund Act, Repeal Act, 2021 and comes into operation on a date to be determined by the responsible Member.

Memorandum on the objects of the North-West Youth Entrepreneurship Service Fund Act repeal Act, 2025

1.BackgroundThe Act seeks to repeal the North West Youth Entrepreneurship Service Fund Act, 2016 (Act No 6 of 2016). The North West Youth Entrepreneurship Service Fund never came into operation since the promulgation of the North West Youth Entrepreneurship Service Fund Act, 2016 (Act No 6 of 2016). Since the promulgation of the North West Youth Entrepreneurship Service Fund Act, 2016 (Act No 6 of 2016) funds appropriated for youth entrepreneurship initiatives have always accrued to the Office of the Premier, which used to have a directorate for youth entrepreneurship. In line with the recent recommendation of the Government Technical Advisory Centre and since the North West Youth Entrepreneurship Service Fund never came into operation, the necessity has arose to repeal the North West Youth Entrepreneurship Service Fund Act, 2016 (Act No 6 of 2016), which is the legislation that established the entity.The Office of the Premier has in the place of the North West Youth Entrepreneurship Service Fund, established an organisational structure at a Directorate level to manage and oversee the coordination of youth advocacy programmes in the province. The Directorate is reporting to the Chief Director-Special ProgrammesThe structure of four staff component has been approved and two posts (of the Director and the Deputy Director) are in the process of being filled.There is an interim acting arrangement on the new Directorate while the process of filling the structure is unfolding. The following are the strategic and operational activities which have been undertaken by the Directorate:Coordination of the development the Youth Programme of Action for 2023/24Monitoring of the implementation of the PlanCoordination of the State of the Province Address pronouncements and Makgotla Resolutions which are relevant to the Directorate.The effect of the repeal the North West Youth Entrepreneurship Service Fund Act, 2016 (Act No 6 of 2016), is that the North West Youth Entrepreneurship Service Fund will be disestablished and upon such disestablishment, cease to exist as a public entity and all assets, liabilities, rights, duties and obligations will vest in, the Office of the Premier.
2.Clause by clause explanationIn summary, the Bill provides as follows—

3.Organisational and personnel implications for provincial governmentSince the North West Youth Entrepreneurship Service Fund as a public entity, never came into operation, no organisational and personnel implications are foreseen in as far as they affect the employment structures of the Office of the Premier.
4.Financial implications for provincial governmentSince the North West Youth Entrepreneurship Service Fund as a public entity, never came into operation, no financial implication in as far as the transfer of staff and assets from the North West Youth Entrepreneurship Service Fund, to the Office of the Premier.
