Case summary

Notwithstanding sec.130 of Act 35 of 1908, whatever rights and obligations a person acquired under previous laws in regard to a sland outside a township were safeguarded to him by sec.77 of that Act, and consequently he may sub-let such stand to a coloured person.

Per DE VILLIERS, J.P. The prohibition against coloured persons residing within proclaimed fields does apply to coloured persons who, in terms of sec.131(3), were lawfully in occupation of certain premises at the commencement of the Act.
