Criminal Law - Sentence - Compensation and Suspension - Act 38 of 1909, secs.11 and 12

 

Case summary

If a prisoner, who has been convicted, desires to be allowed to make compensation in lieu of punishment, under sec.11 of Act 38 of 1909, or have sentence suspended from operation under sec.12 of that Act, as a general rule he must apply to the court of first instance.

Semble, in exceptional cases the Appeal Court has power to exercise the powers provided by those sections.
