Case summary

Under Ord.32 of 1902, sec.57, the contract of sale of liquor by the holder of a bottle store license can only be closed lawfully on the licensed premises, but orders for liquor may lawfully be canvassed off the premises.

A canvasser authorised by the licensee of a bottle store to canvass and receive orders off the premises and to receive money with such orders on the understanding that all such orders are subject to the acceptance or rejection of the licensee, merely by virtue of such authority, cannot lawfully render the licensee guilty of selling liquor off the premises under Ord.32 of 1902, sec.57.
