Husband and Wife - Action against Wife - Assistance of Husband - General Authority granted by Husband

 

Case summary

When a husband has authorised his wife to appoint an attorney to defend her in all proceedings, no special sanction of the husband for his wife's appearance in any act.ion is required, and, therefore, a summons drawn against her "duly assisted by her husband" and served upon an attorney, appointed by virtue of the husband's said general authority, is good, although no service has been effected on the husband.
