Case summary

A Magistrate in the exercise of his discretion may call or re-call any witness after both parties have led their evidence, and the Court will not limit this power.

Where a Statute provides for imprisonment with hard labour as a penalty a Magistrate is not entitled to impose the punishment of spare diet.
