Fencing dispute.-Act 17 of 1912, secs. 26 and 38. Arbitration.Genuineness of dispute.-Amount of contribution in
compulsory areas.

Case summary

Where a detailed account of the cost of erecting a fence under the Fencing Act (17 of 1912) has been furnished by one owner to another and no genuine dispute exists between the owners as to its correctness, the one owner is not compelled to go to arbitration under Sec. 26 of the Act in order to recover the other owner's contribution towards the costs of erecting the fence.
Where a joint boundary fence has been erected in a compulsory area under the fencing Act the owners of the farms must each contribute half ,1£ the cost thereof.
