Case summary

From three weeks after marriage a husband, who was a divorced Roman Catholic, continually stated to his wife that their marriage was a nullity in the eyes of the Church, endeavoured to induce her to live apart from him secretly or go into a nunnery, and at constant intervals found fault, with her. As a consequence of this treatment the wife's health suffered, and she fell ill of enteric and brain fever. He had also refused to provide a home for her or to contribute towards her support, Held that the husband's conduct made the living together of the spouses intolerable, and the wife was declared entitled to a decree of judicial separation.
