Magistrate' s court.-Jurisdiction.-Reduction of claim in summons
to bring case within jurisdiction.

A sued B for £162 10s. as a commission on a sale and reduced that amount in his summons to £100 to bring the claim within the magistrate's jurisdiction, but did not allege that he abandoned the balance. Held, that it was not, necessary to allege that the balance had been abandoned and that an exception to the summons as being beyond the magistrate's jurisdiction had been wrongly upheld.
