Case summary

Per MASON, J. : A magistrate is not bound to give judgment on uncontradicted evidence jf he does not believe it to be sufficient to establish the plaintiff's case. Siko v. Zonsa (1908, T.S. 1013) discussed. Sifjman v. Kriel (1909, T.S. 543) followed.
Where two dogs belonging to different persons jointly attacked a cow belonging to a third person, but it was impossible to separate the exact amount of damage done by each dog, Held, per MASON, J., that the owner of each dog was liable for the full amount of the damage done. Graan v During (2 S.C. 308), and Nel v. Hole (6 S.C. 275) followed.
