Liquor Laws.-Ord. 32 of 1902, sec. 28.-0bjection to renewal of licence.-Notice.-Leavc to carry on business pending rehearing by licensing court.

Case summary

The mere mentioning of a couviction by the licensing court in the course of the hearing of an application for renewal of a liquor licence does not amount to notice of an objection under sec. 28 of Ord. 32 of 1902. Where notice of an objection to renewal of a liquor licence has been given to an applicant the licensing court should grant a reasonable adjournment so as to enable the applicant to bring rebutting evidence in connection therewith. Where an order of a licensing court refusing to renew a licence was set aside the­ court directed the president of the licensing court to sign a certificate for a licence to the applicant until such time as the licensing court shall have reconsidered and dealt afresh with his application.
