Gold Law.-Diggers' licence.-Licence moneys.-Non-producing stage of claim.-Law 15 of 1898, sec. 59.-Act 35 of 1908, secs. 3 and 40 (3).

Case summary

Sec. 59 of Law 15 of 1898 provided for payment, of 20s. per month per licence in respect of digger's licences; but where in other cases the rining commissioner ordered the taking out of a digger's licence only 15s per month per licence need be paid for it. Act 35 of 1908 repealed Law 15 of 1898 and in sec. 40 (3), read together with the definition of " digger's licence " in sec. 3, made provision for the payment of 20s. per month for a digger's licence. The L Company held digger's licences under Law IS of 1898 in respect of which only 15s. per month per licence had been payable. Held, that the said licences were digger's licences under sec. 40 (3) of Act 35 of 1908 in respect of which a fee of 20s. per licence per month had to be paid on renewal.
