Administration of estates .-Landed property -Restraint
on alienation-Minernal lease.

Case summary

Landed property was bequeathed subject to the condition
that it should not be sold except "to the other heirs
and that it should not be encumbered or mortgaged
but descend from generation to generation: -Held,
that, as there was no restraint on the alienation of
the minerals, a mineral lease could be granted over
the property.
