- Case summary

The plaintiff contracted with. a municipality to evecute
for a term of years the cartage work it might require
at stipulated prices, but the municipality did not
expressly contract to give him all or any of the
cartage work:-Held, that a stipulation to that
effect could not be implied, and that there was no
breach of contract by reason of orders for cartage
work being given elsewhere. [Parke vs. Hamman
(1907, T.H. 47) followed. Soeker vs.Colonial Government
(3 Buch. A.C. 207) dissented from.]
