Northern Cape Provincial Political Party Fund Repeal Act, 2021

Act 3 of 2021

ACTTo provide for the repeal of the Northern Cape Political Party Fund Act, 2009; and to provide for matters connected therewith.BE IT ENACTED by the Northern Cape Provincial Legislature, as follows:—

1. Repeal of the Northern Cape Political Party Fund Act 7 of 2009

The Northern Cape Political Party Fund Act, 2009 (Act 7 of 2009) is hereby repealed.

2. Winding up of Northern Cape Political Party Fund

(1)The Political Party Fund established in terms of section 2 of the Northern Cape Political Party Fund Act, 2009 (Act 7 of 2009), is hereby disestablished.
(2)All assets, liabilities, rights, duties and obligations, including any unspent portion of any funds accrued to or received by the Northern Cape Political Party Fund are transferred to, and vest in, the Northern Cape Provincial Legislature.
(3)The Northern Cape Provincial Legislature is, in respect of the assets, liabilities, rights, duties and obligations and funds referred to in subsection (2), for all purposes the successor -in -law of the disestablished Northern Cape Political Party Fund.

3. Transitional arrangements

(1)All unspent portions of any funds standing to the credit of a political party in respect of a bank account envisaged in section 3(1) of the Northern Cape Political Party Fund Act, 2009 (Act 7 of 2009), must, be paid to the respective political parties by 31 March 2021.
(2)If the Secretary of the Legislature is of the view that the funds were spent for activities mentioned in section 5(7) of the repealed Northern Cape Political Party Fund Act, 2009 (Act 7 of 2009), he or she may institute civil proceedings to recover such funds or set off the amount irregularly spent against any allocation that may become payable to that Party.

4. Short title and commencement

This Act is called the Northern Cape Provincial Political Party Fund Repeal Act, 2021 and commences on 31 March 2021.
