North West Directorate of Entrepreneurial Development in Natural Resources Act, Repeal Act, 2014

Act 3 of 2014


To provide for the repeal of the North West Directorate of Entrepreneurial Development in Natural Resources Act, 2003 (Act No. 5 of 2003); and to provide for matters connected therewith.BE IT ENACTED by the Provincial legislature of the Province of North West, as follows:-


1. Definitions

In this Act, unless the context indicates otherwise -"Department" means the department in the Provincial Government of North West responsible for Rural, Environmental and Agricultural Development"Gazette" means the official Provincial Gazette of North West;"Head of Department" means the most senior officer of the department in the Provincial Government of North West responsible for Rural, Environmental and Agricultural Development;"regulations" means regulations made in terms of section 4;"responsible Member" means the Member of the Executive Council responsible for Rural, Environmental and Agricultural Development in the Province;"this Act" includes the regulations contemplated in section 4.

2. Repeal of law

The North West Directorate of Entrepreneurial Development in Natural Resources Act, 2003(Act No. 5 of 2003), is hereby repealed.

3. Disestablishment of Directorate of Entrepreneurial Development in Natural Resources and transitional provisions incidental thereto

(1)The Directorate of Entrepreneurial Development in Natural Resources, including the Advisory Council referred to in section 12 of the repealed North West Directorate of Entrepreneurial Development in Natural Resources Act, 2003, are hereby disestablished.
(2)On the date of the commencement of this Act, all assets, liabilities, rights, duties and obligations, including any unspent portion of any funds accrued or received under the repealed North West Directorate of Entrepreneurial Development in Natural Resources Act, 2003, of the disestablished Directorate of Entrepreneurial Development in Natural Resources, including the Advisory Council referred to in subsection (1), are transferred to, and vest in, the Department.
(3)The Department is, in respect of the assets, liabilities, rights, duties and obligations and funds referred to in subsection (2), for all purposes the successor-in-law of the disestablished Directorate of Entrepreneurial Development in Natural Resources, including the Advisory Council referred to in subsection (1).
(4)The responsible Member must, subject to applicable labour law, deal with the affairs of the employees of the disestablished Directorate of Entrepreneurial Development in Natural Resources who were appointed in terms of the repealed North West Directorate of Entrepreneurial Development in Natural Resources Act, 2003.

4. Responsible member may make regulations

The responsible Member may, if in the application of this Act administrative problems are being experienced, by notice in the Gazette, make regulations to deal such administrative problems.

5. Validation

Any act, determination, designation, decision, matter or any other thing done, made, taken, executed or carried out or purported to have been done, made, taken, executed or carried out by the Advisory Council of the disestablished Directorate of Entrepreneurial Development in Natural Resources appointed in terms of the repealed North West Directorate of Entrepreneurial Development in Natural Resources Act, 2003, in terms of or in pursuance of the repealed North West Directorate of Entrepreneurial Development in Natural Resources Act, 2003, up to the date of commencement of this Act, is not invalid by reason of the repeal of the North West Directorate of Entrepreneurial Development in Natural Resources Act, 2003.

6. Short title

This Act is called the North West Directorate of Entrepreneurial Development in Natural Resources Act, Repeal Act, 2014 and comes into operation on a date to be determined by the responsible Member.
