Criminal Law - Appeal - Postponement of Hearing - Grounds - Private Prosecution - Costs of Unsuccessful Appeal by Accused

 

Case summary

The hearing of an appeal against a conviction by a Magistrate will not be postponed upon the mere allegation by the accused that he has discovered some fresh evidence which will prove his innocence.

The costs of appeal in a private prosecution will not be given against an unsuccessful appellant, unless the appeal is unfounded and vexatious.
