Land Transfer - Practice - Transfer under General Power - Authorisation by Court

 

Case summary

The Court may order a transfer of land to be made on a power of attorney expressed in general terms, provided it is clear that the grantor of the power intended that the transfer should be passed.

Transfer authorised on a general power granted by an excecutor, and authorising the agent to wind up the estate, such transfer being necessary in order to liquidate the estate.
