Defamation - Privilege - Statements made in Court by Litigant in Person

 

Case summary

Comments in Court, made by a litigant bona fide during the conduct of his case, upon the way in which evidence has been obtained by his opponent, are privileged, unless express malice be proved. This privilege extends to comments made by an applicant in person before a Licensing Court.
