Husband and Wife - Antenuptial Contract - Reglstration - Locus staodi of Notary to apply for Registration

 

Case summary

The notary public, before whom an antenuptial contract has been executed, is entitled, under Act 25 of 1909, sec.33(3), to claim relief against all who obstruct him in obtaining registration of such contract, and may apply personally for an order against the Registrar of Deeds to have the contract registered. This right is not extinguished after the lapse of one month from the date of execution of the contract.
