Master and Servant - Industrial Disputes Prevention - Striking before Reference to Board - Averment of Statutory Crime - Act 20 of 1909, sec.6(1)

 

Case summary

An offence can be committed in contravention of sec.6(1) of Act 20 of 1909 only so long as an industrial dispute has not been investigated by a board and a period of one month has not elapsed after publication of the report and recommendation of the board. In charging a contravention of this sub-section, it is essential to aver these facts.
