Case summary

On application by the plaintiff in an action the defendant's plea was struck off the record with costs, but the defendant was given leave to file an amended plea.

Held, that failure to pay the costs as ordered was no bar to the defendant filing an amended plea uniess the failure to pay the costs was vexatious.
