The period of six weeks within which an appeal from a court of resident magistrate should be prosecuted in terms of Rule of Court 95, expired during vacation, and the appeal was set down for the fourth day of term, the first day being a non-court day (Saturday) and the third a public holiday. Held, that the appeal had been properly set· down.
