Criminal procedure.-Evidence on commission.-Belgian Congo.Ord. 1 of 1903, sec. 208.

Case summary

Where an accused had been committed for trial on a charge of rape, the Court, on the application of the Attorney-General, under sec. 208 of the Criminal Procedure Code (Ord. 1 of 1903) granted a commission de bene esse to take the evidence of an important witness before the President of the Criminal Court in Belgian Congo, or such person as he may appoint. The Crown was directed to defray all reasonable expenses necessary to the representation of the accused at the commission by attorney and counsel.
