Defamation - Privilege - Report of Judicial Proceedings - Fair Comrnent -"Moral Pervert"

 

Case summary

The plaintiff was convicted and fined by a magistrate for having solicited a woman in a public street at night for the purpose of committing an immoral act. It happened that he had asked the complainant to go home with him. The defendants published a report of the case containing all the material facts, and headed it "Moral Pervert Punished".

Held, that the report was a fair one, and the description of the plaintiff as a moral pervert was fair comment upon the facts.
