lmpovments - Right of person who, with consent of owner, occupies land not under a lease, but with intention of paying rent - Placaat of 1658.

 

Case summary

A person who, bona fide, occupies land, either under a mistaken belief that he is tenant thereof, or in expectation of a lease being granted to him, the owner consenting to such occupation with the intention of granting him a lease, is a tenant at will. Upon termination  of his occupation, such person is entitled to compensation for the value of standing materials which he has annexed to the soil with the consent of the owner, but he is not entitled to any jus retentionus.
