Costs - Conditional Order - Costs granted on Return Day when not ordered in Rule nisi.

 

Case summary

Where a rule nisi had been granted with no mention of costs, although they had been claimed, and on the return day the defendant was in default, the Court made an order for the payment of costs to become final fourteen days after service of the order on the defendant if the latter before then had not moved to have the order set aside.
