Case summary

In an application by partners for leave to surrender their partnership and private estates as insolvent, schedules of the partnership estate· only were filed, and from them it was impossible to discover the position of the private estates.

Held, that, in the absence of schedules required under Law 13 of 1895, sec.3, leave to surrender the private estates should be
refused.
