Although sec.21 of Procl.21 of 1902 makes no provision for cases of ejectment where no money has been recovered, it does not deprive the Court of its discretion in such cases to make an order for costs on the Magistrate's Court scale; and where an ejectment order is applied for in the Supreme Court, when it could and should have been obtained in the Magistrate's Court, the Court will grant costs on the lower scale only.
