Landlord and tenant - Agricultural lease - Sub-letting without lessor's consent - Forfeiture - Cancellation of lease

 

Case summary

The lessee of a farm, while remaining in possession, sub-let to a third party, without the lessor's consent, the right to live on the farm and to graze cattle thereon.

Held, that the lessee had not thereby forfeited his lease, and that consequently the lessor was not entitled to claim cancellation of the lease.
