In terms of a lease the lessee was not to allow coloured persons, other than domestic servants, to live or dwell on the premises leased.
Held, that it was not a breach of the lease for the lessee to allow a coloured person, not a domestic servant, who had a home of his own, to sleep on the premises as a caretaker.
