Interdict – Mineral and Petroleum Resources Development Act 28
of 2002 (MPRDA) – mining activities conducted in an area not covered by mining
permits but within area of applicant’s prospecting right – court erroneously
dismissing application on the basis of issue not before it – joinder of Minister of
Mineral Resources not necessary – s 47 of the MPRDA not precluding relief
– application to adduce further evidence on appeal – requirements therefor not
established.
