Case summary

Under sec. 22 of Proclamation 21 of 1902 a debtor may
be ordered to pay the costs of civil imprisomnent
proceedings against him if his non-payment of the
debt and costs is vexatious: -Held, that non-payment
is vexatious where the debtor is able to pay the
whole or portion of the debt and refuses either to do
so or to make a reasonable offer.
