Case summary

Where·a party had been ordered to vacate certain.premises on or before a certain day, and he had noted an appeal to the Appellate Division, the Court refused to enforce the order pending the appeal on the grounds that the appeal was not ve,vatious, and if the appellant were ejected and succeeded in his appeal, it would be most dificult to restore the status quo.
