Sec. 24 (1) of Ordinance 2 (Private) of 1906 empowers
the Mitnicipal Council of J ohannesbitrg to make and
keep in repair all streets vested in and placed under
the management and control of the Council:Held,
on appeal (DE VILLIERS, J.P., dissentiente'),
that, there being no obligation on the Council to repair
streets, it was not liable in damages for injury
resulting from subsequent disrepair of a street properly
constructed.
