Criminal Law-Advertising as consulting chemist and druggist. Sec.39 of Ord. 29 of 1904.

Case summary

Sec. 39 of Ord. 29 of 1904 provides inter alia that any person who shall wilfully and falsely take or use the name or title of an apothecary or any name,
title or description implying or calculated to lead people to infer that he is registered under this Ordinance, etc., shall -be guilty of an offence. An unregistered person advertised himself in a newspaper as a consulting pharmaceutical and homeopathic chemist, apothecary and druggist, of.Amersfoort, Transvaal. '" Held, that he had called himself a chemist, druggist and apothecary under circumstances which would lead the public to imply that he was registered as such under the Ordinance, and that he had therefore been rightly convicted of contravening sec. 39 thereof.
