Case summary

A Mining Commissioner has no focus standi to sue for setting aside the grant of a stand made by his predecessor in terms of sec. 78 of Act 35 of 1908. Such proceedings should be instituted by the Minister of Mines as representing the Government. Minister of Railways v. Municipality of Johannesburg (1912,A.D. 595), applied.
