A report, made by an architect upon instructions, given at the instance of the pnncipal' s attorney, at a time when such principal contemplated or anticipated litigation on the matter submitted for report, is privileged from disclosure in the course of such litigation,
instituted after such instruction had been given, notwithstanding
the fact that hopes of a settlement had been subsequently entertained by the principal. (Anderson vs. Bank of British Columbia, 45 L.J. Ch.449, followed).
