Act 3 of 2020

(English text assented to and signed by the Premier on 24 March 2020.)ACTTo authorise certain unauthorised expenditure and to provide for matters connected therewith.BE IT ENACTED by the Provincial Legislature of the Province, as follows:

1. Authorising of expenditure

(1)The unauthorised amount of R 437 780 761.55 set out in the Schedules which-
(a)the Provincial Account Committee recommended for authorisation by the Provincial Legislature;
(b)is more fully described in the Report of the Auditor General of South Africa on the Annual Financial Statements for the 2016/17 and 2017/18 financial years,
is hereby authorised in terms of section 34 of Public Finance Management Act, 1999 (Act No. 1 of 1999) in the manner set out in subsections (1) and (2).
(2)The unauthorised amounts due to an overspending of the main divisions within a vote referred to-
(a)in the second column of Schedule A, expenditure become direct charges against the Provincial Revenue Fund in the financial year(s) indicated in column 3, respectively;
(b)in the second column of Schedule B, expenditure become a direct charge against the relevant Votes in the financial year(s) indicated in column 3.

2. Amendment of Finance Act, 2018 (Act No. 3 of 2018)

Schedule C of the Finance Act, 2018 (Act No. 3 of 2018) is amended by the substitution for the information regarding Education in aforesaid Schedule with the information set out in Schedule C hereto.

3. Short title

This Act is called the Finance Act, 2020.
