Case summary

Where C had paid T a sum of money to send to two of his (C's) creditors by cheque, and T failed to do so and was convicted in the lower court of theft by conversion, Held, on appeal, that was merely the duct for passing money from C to his creditors, and in keeping the money and not sending the cheques he had committed the crime of theft. Appeal dismissed.
