Case summary

Where P and L had entered into a contract under which L was to use his own oxen to plough P's land, and L, on being asked how many oxen he had, replied "Fifteen," and he subsequently brought another ox on to P's land, which P allowed to remain for two days and then impounded, Held, on appeal from the magistrate's court, that L had a right to bring the ox, which was consequently not trespassing, and that P was wrong in impounding it.
