Case summary

Where A had arrested G without a warrant for a contravention of
sec. 41 of Ordinance 8 of 1903 by suppiying a native with liquor
in A's presence, Held (WARD, J., dissenting), that the arrest was
wrongful. Held, further, that as only nominal damages could be awarded, and as G had failed to establish the alibi set up, G should pay A's costs for the last three days of the trial and all costs in connection with A's witnesses.
