Company Law – principles relating to court applications for winding-up of a
company restated – intervening voluntary winding-up does not extinguish a pending
application for compulsory winding-up – where compulsory winding-up supersedes the
pending voluntary winding-up provisions of s 340(2)(a) of the Companies Act 71 of 1973
apply – compulsory winding-up shall be deemed to have been effective from date of
registration of the special resolution for the voluntary winding-up of a company.
