Court set aside an assault GBH conviction to permit prosecution for murder under inherent powers in the interests of justice.
Criminal procedure – review by superior court using inherent powers (s173) – setting aside valid lower‑court conviction where new material (death of complainant) warrants more serious charge – section 304A inapplicable – section 35(3)(m) (double jeopardy) not breached where interests of justice justify de novo proceedings.
